Probate is the legal process of administering the estate of a deceased person.  It involves validating the Will, paying any debts and taxes, and distributing the remaining assets to the beneficiaries.


The Probate Process


The Probate process can be complex and time consuming.  It typically  involves the following steps:


  • Application for Grant of Probate: The executor named in the Will applies for the legal authority to administer the Estate.
  • Validation of the Will: The Will is proven in court to be the legitimate final testament of the deceased
  • Payment of the Debts and Taxes: Outstanding debts and taxes are settled from the Estates funds
  • Distribution of Assets: The remaining assets are distributed to the beneficiaries as outlined in the Will.

Power of Attorney (POA)

A POA offers peace of mind by ensuring that your affairs are managed by someone who understands your wishes. You can also revoke or update your POA at any time.


A Power of Attorney (POA) is a critical legal document that holds as much significance as a Will, if not more. It's a misconception that a POA is only necessary for the elderly; in reality, individuals of any age should consider establishing one. While a Will ensures that your assets are allocated to the correct beneficiaries after your death, a POA safeguards your interests if you lose the ability to manage your own affairs due to mental incapacity or other reasons.

Types of POA

  • A Health & Welfare POA: - for decisions about your care and wellbeing.
  • A Property & Financial Affairs POA: - for decisions about your money and property.
  • General Power of Attorney:- Grants broad powers to the appointed person for a limited period, typically used for a temporary situations
  • Enduring Power of Attorney:- This is an obsolete forerunner to the LPA, currently no EPA's are created, but if you have one that was created before 2007, it is still valid.  An EPA only covers financial affairs, so we would recommend replacing it with an LPA to include health and welfare.  If you do retain your EPA you would have to have it registered with the Office of the Public Guardian (OPG) before it can be used in the case of loss of mental capacity.
